Death penalty case set for USS Cole defendant

A senior Pentagon official Wednesday referred the first death penalty case under President Obama for trial by military commission at Guantanamo Bay, Cuba.

Abd al-Rahim al-Nashiri was charged in April by military prosecutors with murder, terrorism and other violations of the laws of war for his role in the October 2000 al-Qaeda attack on the USS Cole in Yemen.

Under military rules, the Pentagon official, known as the Convening Authority, independently examines the charges filed by military prosecutors and decides whether the defendant will be tried on all, some of none of the charges. In Nashiri’s case, the Convening Authority, Ret. Admiral Bruce MacDonald, forwarded the capital charges sworn by prosecutors.

Nashiri, a Saudi citizen of Yemeni descent, is one of 15 high-value detainees held at Guantanamo, and prosecutors allege that he was “in charge of the planning and preparation” of the Cole attack. Two suicide bombers in a small boat pulled alongside the Navy destroyer in the port of Aden and the ensuing blast, which ripped a 30-by-30-foot hole in the ship, killed 17 American sailors.

Iran sentences popular rapper to death for supporting Mahsa Amini protests

An Iranian court has sentenced to death a popular rapper jailed for more than a year and a half for supporting nationwide protests sparked by Mahsa Amini's death, local media reported Wednesday . "Branch 1 of Isfahan Revolutionary Court sentenced Toomaj Salehi to death on the charge of corruption on Earth," the singer's lawyer Amir Raisian said, quoted by the reformist Shargh newspaper.

PETALING JAYA: Amnesty International Malaysia has commended Malaysia for the abolition of the mandatory death penalty and for imposing a moratorium on the execution of the death sentence, which has led to an overall decrease in the use of the death penalty by the courts. However, the rights group urged the government to extend the moratorium on executions until the death penalty is fully abolished.

Kansas - A judge has denied a request by death-row inmates Jonathan and Reginald Carr to be resentenced in a December 2000 crime spree that included five murders. The Carr brothers filed motions in November requesting a new hearing to determine whether the evidence supports the death penalty. Their lawyers also sought new pre-sentencing reports and journal entries in the case.
